Privacy Notice Regarding the Processing of Personal Data

This Privacy Notice has been prepared by Destek Her Yerde Bilişim Anonim Şirketi, who is the data controller under the Law No. 6698 on Protection of Personal Data ("KVKK") regarding the use of personal data obtained from Personal Data Subjects and/or third parties in relation to the healmeup mobile application (hereinafter referred to as "site"), to inform and enlighten you transparently about the methods of collecting your personal data, the purposes and legal reasons of personal data processing activities, the principles regarding the transfer of personal data if they are transferred, and your rights as a data subject.

Your Personal Data that you share as a personal data subject under KVKK will be collected and processed by the Company designated as Data Controller within the scope specified below.

1. DEFINITIONS and ABBREVIATIONS

Personal Data Subject: The natural person whose personal data is processed,

KVKK: Law No. 6698 on Protection of Personal Data published in the Official Gazette on 7 April 2016 and entered into force,

Data Processor: The natural or legal person who processes Personal Data on behalf of the data controller based on the authority given by the data controller,

Data Controller: The natural or legal person who determines the purposes and means of processing Personal Data and is responsible for establishing and managing the data recording system

Website/Site: Refers to www.healmeup.com and mobile application.

2. PROCESSED PERSONAL DATA

Although the types and numbers of personal data processed depending on your relationship with the Company will vary according to the reason for processing; Personal Data that you share with the Company or obtained by the Company from third parties consist of the following.

Address information, users' phone numbers, email addresses

Credit Card Information, Bank Information, Account Holder Information

Behaviors within the site, location, browser information, operating system information, site visit times, habits, interests, IP address information

Camera recordings if explicit consent is given during online meetings, voice recordings for calls made with our call center and communication numbers

Transaction Security Data

Internet system logs, User session information.

Your personal data is processed in accordance with the general principles set out in Article 4 of KVKK, in compliance with law and honesty rules, accurate and up-to-date when necessary, for specific, clear and legitimate purposes, limited and proportionate in connection with the purpose for which they are processed, and kept for the period prescribed in the relevant legislation or necessary for the purpose for which they are processed.

Personal data cannot be processed without the explicit consent of the Personal Data Subject pursuant to Article 5 of KVKK. However, according to the provision of the same article, if one of the following conditions exists, it is possible to process personal data without seeking the explicit consent of the Data Subject:

Being explicitly provided for in laws,
Being necessary for the protection of the life or physical integrity of the person who is unable to express his consent due to factual impossibility or whose consent is not legally valid, or of another person,
Being necessary for the processing of personal data of the parties to a contract, provided that it is directly related to the establishment or performance of a contract,
Being necessary for the Data Controller to fulfill its legal obligation,
The personal data being made public by the Data Subject himself,
Being necessary to process data for the establishment, exercise or protection of a right,
Being necessary to process data for the legitimate interests of the Data Controller, provided that it does not harm the fundamental rights and freedoms of the Personal Data Subject.

3. GENERAL PRINCIPLES REGARDING THE PROCESSING OF PERSONAL DATA, CONDITIONS AND PURPOSES OF PROCESSING PERSONAL DATA

The Company processes your personal data subject to this Privacy Notice for the fulfillment of obligations arising from legislation, carrying out the necessary work by business units to benefit relevant persons from the products and services offered by our website/mobile application and executing related business processes, carrying out the necessary work by relevant business units for the realization of service activities carried out by our website/mobile application and executing related business processes, planning and execution of commercial and/or business strategies of our website/mobile application, ensuring the legal, technical and commercial-business security of relevant persons in business relationship with our website/mobile application, and planning and execution of activities necessary for recommending and promoting the products and services we offer to relevant persons by customizing them according to the preferences, usage habits and needs of relevant persons.

4. METHODS AND LEGAL REASONS FOR COLLECTING PERSONAL DATA

Your Personal Data can be collected, processed and transferred by the Company through channels such as www.healmeup.com, E-mail, call center, camera recording, voice recording, mobile application in accordance with the basic principles envisaged by KVKK, within the scope of personal data processing conditions specified in Articles 5 and 6 of KVKK for the purposes specified in this Privacy Notice.

Your personal data subject to this Privacy Notice is processed based on the legal reasons of being directly related to the establishment or performance of a contract and being necessary for the legitimate interests of the Data Controller.

5. TRANSFER OF PERSONAL DATA, TRANSFER PURPOSES AND PERIODS

Identity Data

6. SECURITY OF YOUR PERSONAL DATA

To protect your personal data, the Company takes appropriate measures consistent with relevant privacy and data security laws and regulations and implements technical and institutional measures to prevent risks such as destruction, loss, alteration, unauthorized disclosure or unauthorized access to your data, depending on the state of technology, implementation costs and the content of the data to be protected.

Personal data subject to this Privacy Notice is kept accessible only to limited persons within the Company. These personal data will be deleted, destroyed or made anonymous at the end of the processing period as shown in the Company's Personal Data Protection and Destruction Policy.

7. RIGHTS AND OBLIGATIONS OF THE PERSONAL DATA SUBJECT

Personal data subjects are responsible for ensuring that the personal data they share with the Company is accurate, complete and up-to-date, and if personal data belonging to other persons is shared, that such data is collected in a valid and legally compliant manner.

Within the scope of KVKK and related legislation, Personal Data Subjects;

Learning whether personal data is processed,
Requesting information about this if personal data has been processed,
Learning the purpose of processing personal data and whether they are used in accordance with the purpose,
Knowing the third parties to whom personal data is transferred domestically or abroad,
Requesting correction of personal data if it has been processed incompletely or incorrectly,
Requesting deletion or destruction of personal data,
Objecting to the emergence of a result against the person as a result of analyzing the processed data exclusively through automated systems,
have the right to request compensation for damages in case of damage due to unlawful processing of personal data.

In accordance with the provisions of Law No. 6698 on Protection of Personal Data and related regulations ("KVKK Regulations"), all kinds of information that makes your identity specific or identifiable, including your special qualified personal data, is qualified as Personal Data and is processed by Healmeup as Data Controller within the scope explained below and within the limits prescribed by legislation.
